Coverage Declination Requirements
    
    
    
        
            Section 9 of Plan rules (Eligibility) requires producers and applicants to certify that during
            the preceding 60 days, they have attempted to secure coverage in the voluntary market at rates not
            exceeding the Plan.  At the direction of the New York State Insurance Department, the Plan has
            expanded its applications to require producers and applicants to indicate the names of one to
            three carriers who have declined the applicant for coverage during the preceding 60 days and the
            reasons for the declinations.
        
        
        
            Additionally, if the producer has no access to voluntary markets,
            the producer will be required to indicate such in lieu of the declination information.  PASS has
            been revised to reflect these requirements.  All other application forms will be revised to reflect
            these requirements and will be published on the On Line Forms Library.
